The Law on Mediation in Civil Disputes has undergone significant transformations over time in response to changing social needs and the expansion of its fields of application. The most recent and comprehensive step in this process was taken with the adoption of Law No. 7445 by the Grand National Assembly of Türkiye on 28 March 2023, which was published in the Official Gazette on 5 April 2023. Through this amendment, the institution of mediation was restructured to include new areas within the scope of mandatory mediation. With the entry into force of these regulations as of 1 September 2023, mediation has become compulsory in disputes arising from lease relationships, condominium ownership, neighborhood law, and actions for dissolution of co-ownership, thereby significantly broadening the practical scope of the institution.
In order to evaluate the impact of these fundamental changes on judicial practice, legal doctrine, and dispute resolution mechanisms through a holistic approach, a symposium was organized bringing together leading academics and practitioners in the field. The scholarly papers presented at the symposium have been compiled in this volume with the aim of creating a lasting academic resource that provides a multidimensional analysis of the current transformation of mediation law. With its evaluations guiding both academic research and legal practice, this work serves as an important reference source for researchers and practitioners working in the field of mediation.
