This volume, consisting of the full texts of the papers presented at the Future of Mediation Symposium, examines the current structure of the mediation institution in Türkiye, the challenges encountered in practice, and future areas of transformation from a multidimensional perspective. Although mediation has deep historical roots and has long been known and practiced in various forms, it was formally incorporated into the modern Turkish legal system through Law No. 6325 on Mediation in Civil Disputes. With the introduction of mandatory mediation as a precondition to litigation, the visibility and practical use of mediation have increased significantly. However, despite the fact that less than a decade has passed since its enactment, the Law—primarily designed on the basis of voluntary mediation—has gradually begun to reveal theoretical and practical inadequacies in light of evolving needs and accumulated implementation experience.
During this period, significant developments have also taken place at the international level, particularly with the adoption of the Singapore Convention, which aims to facilitate the cross-border enforcement of mediated settlement agreements. Türkiye’s accession to this Convention has further highlighted the necessity of reassessing mediation not only within a domestic framework but also from an international perspective. In this context, the Full Text Proceedings Book brings together comprehensive analyses addressing mediation in light of legislative developments, practical experience, professional standards, education, digital transformation, and international legal instruments.
