In the event, where mediation in commercial space disputes was discussed for the first time in Turkey and moderated by Prof. Dr. Ali Yeşilırmak, Assoc. Prof. Dr. Sezercan Bektaş from Sakarya University Faculty of Law discussed in detail the effects of space law on commercial disputes and the role of mediation methods in this field.
In the first part of her presentation, Assoc. Prof. Dr. Sezercan Bektaş focused on how international law regulates space activities and the role of key international treaties such as the 1967 Space Treaty in space activities, and emphasized that commercial space activities in particular consist of complex processes carried out by non-governmental organizations and the private sector, and that these processes are linked to national legislation. He also stated that commercial space activities are directly related to elements such as insurance, confidentiality and export control regulations, and that these complex regulations are usually regulated by contracts signed between the parties. The characteristics of commercial contracts, the management of technical processes such as the construction, launch and operation of spacecraft, and the necessity of alternative solutions such as mediation and arbitration, which play an important role in resolving disputes arising from these activities, were discussed by Assoc. Prof. Dr. Bektaş.
Assoc. Prof. Dr. Bektaş also elaborated on the unique characteristics of commercial space disputes. He stated that international commercial arbitration has been an effective method for resolving such disputes from the past to the present and that mediation stands out as a flexible and effective means of resolution in these processes. He emphasized that mediation, especially in commercial space activities, saves time and cost for the parties and encourages greater participation of the parties in the resolution process.
