Arbitration and Other Alternative Dispute Resolution Methods for Disputes Arising out of Savings Finance Contract (In the Context of Consumer Law)

The rapidly changing economic structure and evolving consumption habits have led to a diversification of financial products and services; in this process, savings financing contracts have become widely used in Turkey, particularly in the areas of housing and vehicle acquisition. This widespread use has also brought about numerous consumer disputes.

This work examines the extent to which disputes arising from savings financing contracts can be effectively resolved within the existing legal system; it analyzes in detail the role of arbitration, mediation, and other alternative dispute resolution methods in the face of the limitations of the judicial system.

The study is not limited to Turkish law; practices in Germany, Switzerland, the United Kingdom, the United States, and European Union countries are examined using a comparative law approach. Through this comparative study, applicable and unique solution models for Turkey have been developed.

The work brings together the disciplines of law, economics, and consumer protection from a holistic perspective, offering concrete suggestions for application alongside theoretical evaluations. In particular, the balance that must be established between the effective protection of consumer rights and the sustainability of the financial sector is one of the main focuses of the study.
