A Legal Evaluation of Monitoring and Surveillance Tools in Telework From the Perspective of Personal Data Protection

With the impact of digital transformation on working life, the teleworking model has become a significant element of modern work relationships. This new form of work has led to the widespread use of various monitoring and surveillance tools in the work process; consequently, it has brought to the forefront new legal debates regarding the protection of employees' personal data and the privacy of their private lives.

This work examines the monitoring and surveillance methods used in teleworking relationships within the context of personal data protection law, investigating the delicate balance that must be struck between the managerial interests of employers and the fundamental rights and freedoms of employees. Physical, electronic, biometric, and artificial intelligence-based monitoring applications are evaluated in their legal, technical, and practical dimensions, and the legal consequences of processing personal data obtained in these processes are discussed in detail.

Within the scope of the study, the lawful processing of personal data, the obligations of data controllers, the rights of employees, and technical and administrative measures to ensure data security are presented from a holistic perspective. With its interdisciplinary approach, the work aims to both provide solutions to problems encountered in practice and contribute to the creation of a measured, balanced, and sustainable legal framework for teleworking relationships.
